Visa for persons with exceptional ability

The O-1 visa is a nonimmigrant work visa designed for persons of extraordinary ability in the sciences, arts, business, athletics, education, or for those who have demonstrated outstanding achievement in the film and television industry. I. What is an O-1 visa?

O-1 visas are available to individuals with Extraordinary Ability (EA) in the following areas:

  • O-1A: Science, education, business, sports
  • O-1B: Arts, Film and Television Industry

Core features:

  1. Application must be submitted by a U.S. employer or agent (not self-employed)
  2. Initial validity up to 3 years, renewable indefinitely (1 year each)
  3. Permission to work for multiple employers
  4. Spouse and children may accompany spouse on O-3 visa (spouse may not work)

III. Six Application Requirements

  1. Demonstration of extraordinary ability (one of the following needs to be met):

  3. Meet at least 3 industry achievement standards (standards vary by field)
  4. Continuing to maintain industry prestige
  5. Work in the U.S. in a specialized field
  6. The nature of the work is "Event": including conferences, shows, seasons, permanent positions, etc.
  7. Application submitted by U.S. employer/agent
  8. Provide a peer review opinion: from a professional association or an industry authority

* :: Criteria for domain segmentation:

  • O-1A (Science/Business/Education/Athletics): Proof of belonging to the top few in the industry (e.g., national awards, important academic papers, judging experience, etc.) is required.
  • O-1B (Art/Film): Proof of "outstanding reputation" (e.g., international recognition for starring work, high remuneration, authoritative media coverage, etc.) is required.

V. Four-step application process

  1. Hiring an Immigration Attorney: Evaluating Qualifications and Developing a Strategy
  2. Gathering Materials: Preparing Proof of Achievement and Employment Documents
  3. Filing Form I-129: Petition by Employer or Agent (with Supplemental Form O)
  4. Consular interview (if applicable): Visa processing at embassy or consulate after I-129 approval

VI. Analysis of the difficulty of obtaining approval

VII. O-1 to Green Card Pathway

  1. EB-1A Outstanding Talent Green Card: Stricter standards than O-1 but self-applicable
