L-1 and EB-1C Core Requirements
L-1 Nonimmigrant Visa (8 U.S.C. § 1101(a)(15)(L))
- ·Employed by an affiliated foreign entity for 1 continuous year within the past 3 years
- ·Capacity as executive, manager (L-1A) or specialized knowledge employee (L-1B)
- ·Transferring to a qualifying US affiliated entity in the same capacity
EB-1C Employment-Based 1st Preference (8 C.F.R. § 204.5(j))
- ·Requires I-140 immigrant petition by a US employer
- ·US company must have been doing business for at least 1 year
- ·Applicant must be employed in a managerial or executive capacity
